These Terms of Service (“Terms”) govern your access to and use of the TNT Grill & Catering mobile application (the “App”) and any services provided through it (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
1) Who may use the Services
- You must be able to form a binding contract in your jurisdiction.
- The Services are not intended for children under 13. If you are under 13, do not use the Services.
2) Accounts and authentication
- You may use certain parts of the App as a guest. Some features may require creating an account and signing in.
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
3) Orders, pickup, and catering requests
Ordering
- The App allows you to place pickup orders with TNT.
- When you submit an order, you agree that the information you provide (name, email/phone, pickup details) is accurate.
Pickup timing and availability
- Pickup times and availability may change based on kitchen volume, store hours, inventory, or other operational constraints.
- We may limit quantities, pause ordering, or refuse/void orders when necessary (for example: suspected fraud, pricing errors, unavailability, or operational constraints).
Catering requests
- Catering requests submitted through the App are requests for contact/quotation and are not binding until TNT confirms details.
4) Pricing, fees, and taxes
- Prices shown in the App are in USD unless stated otherwise.
- Taxes and fees (if applicable) will be shown during checkout.
- We may correct pricing errors and may cancel/refund orders impacted by an error.
5) Payments
- Payments may be processed by third-party payment processors (for example, Stripe). Your use of their services is subject to their terms and privacy practices.
- We do not store full payment card numbers in our systems.
6) Cancellations, refunds, and issues
- Because food is prepared to order, refunds and cancellations may be limited.
- If you have an issue with an order, contact support promptly at
tntgrillandcafellc@gmail.comwith your order details. - TNT reserves the right to decide whether to provide a refund, replacement, or other resolution, subject to applicable law.
7) Promotions
- Promotions, discounts, and offers are subject to additional terms shown in the App or at the point of redemption.
- Promotions may be time-limited, limited-quantity, and may be changed or ended at any time.
8) Notifications and communications
- If you opt in, we may send you push notifications (e.g., order updates) and/or emails (e.g., receipts, updates, marketing).
- You can change notification preferences in the App’s Settings.
- Standard message/data rates may apply depending on your carrier/plan.
9) Acceptable use
You agree not to:
- Use the Services in a way that violates any law or regulation.
- Attempt to access non-public areas, accounts you do not own, or systems you are not authorized to access.
- Interfere with or disrupt the Services (including by introducing malware or abusing APIs).
- Reverse engineer or attempt to derive source code except to the extent such restrictions are prohibited by law.
10) Intellectual property
- The Services, including trademarks, logos, UI, and content (excluding user-submitted content), are owned by TNT or its licensors and are protected by applicable laws.
- You may not copy, modify, distribute, sell, or lease any part of the Services without our permission.
11) Third-party services and links
The Services may integrate with or link to third-party services (e.g., Supabase, Expo, Stripe, maps providers). We are not responsible for third-party services and your use is subject to their terms and privacy policies.
12) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TNT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TNT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; OR (C) ANY OTHER MATTER RELATING TO THE SERVICES.
IN NO EVENT WILL TNT’S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO TNT THROUGH THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
14) Indemnification
You agree to indemnify and hold harmless TNT and its owners, employees, contractors, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or violation of these Terms.
15) Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles, except where prohibited by applicable law.
16) Changes to these Terms
We may update these Terms from time to time. We will update the effective date above and may provide additional notice within the App. Continued use of the Services after the effective date means you accept the updated Terms.
